She then struck her repeatedly with both sides of the hammer on the head, she told the court. I went back to the vehicle and I savagely murdered that little girl,' she said to a stunned and horrified courtroom. They both buried the body, she recounted, before washing themselves and the car so no evidence could be found. The pair had been dating just over a month when they carried out the gruesome crime. McClintic said it was Rafferty's idea and said they would be like Bonnie and Clyde.

She has lied in the past and she lied to the jury, Derstine said, with one exception. Derstine began his closing arguments by thanking the member jury, telling them their role will now change from spectators to decision makers. He also urged jurors to judge the trial dispassionately, saying it has been set against the backdrop of an "unspeakable tragedy. Derstine suggested Rafferty was simply a horrified spectator to the abduction and death of the girl and that McClintic was the "engine" behind the events on April 8, Earlier in the trial, Derstine suggested to McClintic that she took the girl over a "drug debt" and later offered her to Rafferty as a sexual gift, which he rejected.
McClintic then killed the eight-year-old while he was away from the car. But Rafferty's lawyer didn't repeat it in his closing remarks. He did not offer an explanation as to why McClintic might have killed Tori or even targeted her at all, but Derstine reminded the jury he doesn't have to prove anything.
The onus is on the Crown to establish guilt beyond a reasonable doubt. The new regulations would make it more difficult for prisoners serving long-term sentences to be moved to such facilities. The matter was later dropped. Up until her move to the healing lodge, McClintic had received 23 infractions while at Grand Valley. Rafferty was eventually moved from a maximum-security prison to the medium-security La Macaza Institution in Quebec.
This too angered the Stafford family. However, despite public outcry, Goodale held firm on the decision, insisting the prison was no less secure than others and that it specialized in the treatment of sex offenders. Since the review, the criteria has been broadened, with law enforcement agencies no longer needing proof that an abduction has occurred, only that the missing child could be in danger. Rodney set up a Change. She started using OxyContin again not long after and has since sought treatment for her relapse.

In March , news organization Global News learnt that Rafferty had been accused by family members of extorting his mother and grandmother while in jail. One family member alleged Rafferty made calls while he was in maximum-security, saying he was in the infirmary and needed money to buy himself protection.
The relative provided Global with copies of cheques and money order receipts spanning from to , which showed his mother had sent tens of thousands of dollars to the spouses of inmates in Quebec and British Columbia.
She did not know any of these individuals personally. When Global contacted those named in the documents, they would not corroborate the claims. Rafferty also refused to comment. The relative in question repeatedly contacted the CSC to try and stop the calls, but they continued to occur. He also claimed to have had an email conversation with officials throughout most of , which included him sending copies of the receipts, but he has yet to hear anything further.
In a statement to Global , a spokesperson with the CSC said that, given the Privacy Act, they were unable to comment on specifics, but that they review any and all information brought to their attention by victims and the families of inmates.
Once his mother was unable to support him, Rafferty turned to his grandmother, who passed away shortly after his mother. The relative who contacted Global claimed he and Rodney had written to the government, asking for an opportunity to discuss what Rafferty was doing behind bars and why he should be moved back to a maximum-security prison, but they have not received a response back.

Meloche says Rafferty was constantly on his BlackBerry, checking his emails and sending text messages — a common observation reported by the women he was dating in April 19 — David Broad, senior manager for information security and digital forensics at Bell Canada, presents Rafferty's BlackBerry records, which show a number of data and voice calls were made in Woodstock, Guelph and near Mount Forest the day Tori disappeared.
The location and time data, obtained from cellular towers, seem to match up with the timeline of events described by McClintic. Under cross-examination, Broad explains that the data is only good at determining when a call was started and another radio transmission expert, Mustafa Bakhtyar, testifies that it cannot be used to pinpoint a person's location. May 1 — The defence calls a single witness, a woman who picked up her grandchildren from Oliver Stephens Public School the day Tori disappeared, ending speculation Rafferty would testify.
The grandmother, whose name is protected by a publication ban, tells jurors she saw a woman matching McClintic's description enter the school and later saw her walking down the street with a young girl. Defence lawyer Derstine also reads out an agreed statement of facts that said there was students at Tori's school the day she vanished.
May 7 — Derstine tells the jury that McClintic is an "accomplished liar" with a history of violence during his closing argument.
